Shipping Policy — Cannabinoid & THC-Containing Products

At HIGH VIBE, we’re committed to delivering your order safely, legally, and transparently. Because products containing THC or cannabinoids are subject to specific regulatory requirements under federal law, New York State law, and local rules in New York City, the information below explains how we ship these products and what you can expect.

📦 What Products We Ship

We only ship products that are lawful to ship under federal and applicable state laws. This generally includes:

• Products derived from hemp containing no more than 0.3% Δ9-THC by dry weight (in line with the federal 2018 Farm Bill) when shipped legally domestically.  

🚫 Federal Shipping Restrictions

Under federal law:

• Marijuana (higher-THC cannabis) remains illegal to ship via USPS, UPS, FedEx, or other carriers in interstate commerce, even if a product is legal under some state laws.  

• Synthetic cannabinoids and lab-made cannabinoid analogs are generally prohibited from shipment.  

Because of these laws, we do not ship products that exceed federal thresholds for THC or that are prohibited by federal carriers.

📍 New York State Rules

New York State regulates “cannabinoid hemp” products through the Office of Cannabis Management. Products offered for sale must comply with state potency and labeling requirements, including limits on intoxicating cannabinoids and appropriate warnings.

Depending on current NY regulations, some cannabinoids (e.g., delta-8, delta-10) may not be allowed for sale or distribution. It is your responsibility to understand and follow the laws in your location before ordering.

📦 Shipping Method & Compliance

• All eligible shipments are sent using carriers that permit legally compliant hemp shipments and require Adult Signature Required upon delivery.  

• Your order may be delayed or canceled if it cannot be shipped legally to your address under federal, state, or local law.

We do not ship products that are illegal to receive in your state or local jurisdiction. Because THC and cannabinoid laws differ across the U.S. and worldwide, we cannot guarantee that products legal in New York will be legal where you live. • Third-party lab testing certificates (Certificates of Analysis) showing compliance with legal THC limits.

🚫 Order Cancellations Due to Legal Compliance

If an order cannot be fulfilled due to carrier restrictions or changes in local law, we may cancel the order and notify you. Refunds will be issued according to our Refund Policy.

1. General Delivery Requirements

To ensure compliance with New York State cannabis regulations:

• Age Verification: Deliveries are only made to individuals 21 years or older. We verify ID at the time of delivery to confirm age and identity.  

• Prepayment Required: All delivery orders must be paid in full online before fulfillment — we do not accept cash on delivery.  

• Recipient Presence: The person who placed the order must be present to receive the delivery and show valid government-issued ID.  

• Delivery Locations: Deliveries are only permitted to:  

  • Private residences (including short- and long-term residences)  

  • Private business addresses within New York State.  

• Restricted Delivery Areas: Deliveries cannot be made to:  

  • Public buildings or public spaces (e.g., parks)  

  • Community centers  

  • School grounds  

  • Day-care facilities  

  • Houses of worship  

  • Inside motor vehicles.  

• Order Accuracy: Only the individual named on the order can receive the delivery, following state identity verification requirements.  

2. Delivery Process & Timing

Once your order is placed and paid:

• You will receive an order confirmation with an estimated delivery window.  

• A delivery team member will attempt delivery during scheduled service hours.  

• At delivery, ID and age will be verified before handing off products.  

• You may be asked to sign a delivery receipt acknowledging receipt and compliance.  

3. Same-Day Delivery

We may offer same-day delivery when all of the following conditions are met:

• Your order is placed before 11:00 AM on the same day of expected delivery.  

• Same-day service is available in your specific delivery zone.  

• Product availability permits fulfillment.  

Same-day delivery is not guaranteed and may be limited due to volume, staffing, weather, or regulatory constraints. When available, same-day delivery options and pricing will be offered at checkout.

4. Non-Member Delivery (Guest Service)

Non-members can enjoy delivery service subject to the following:

• Valid Identification: You must meet all age and ID requirements at delivery.  

• One-Time or Occasional Use: Delivery access is available for guests without membership accounts, as long as state regulatory requirements are met.  

• Compliance Checks: Non-members are subject to the same verification and delivery restrictions as registered customers.  

• Account Creation: We may require non-members to create a temporary profile for order tracking and compliance purposes.  

5. Delivery Hours & Limitations

• Deliveries are made only during lawful operating hours as allowed under state and local licensing rules.

6. Safety & Compliance

• Our delivery personnel are trained to comply with all cannabis transport rules, including secure handling and manifest tracking.  

• We maintain required delivery documentation and inventory control as mandated by New York regulators.  

• Licensees and delivery agents do not solicit orders in public or private spaces and carry identification as required.  

7. Order Cancellations or Rescheduling

If your delivery cannot be completed due to compliance issues (e.g., no ID presented, incorrect address, inaccessible delivery location), we may cancel or reschedule your delivery. In such cases, you will be notified and offered options for redelivery or refund in accordance with our refund policy.
